Governor Jon Corzine Files Motion to Join Sports Betting Suit

TRENTON – Governor Jon S. Corzine today submitted a motion to intervene in support of a lawsuit filed by Senator Ray Lesniak in March with the Interactive Media Entertainment and Gaming Association and three horse racing groups.  The lawsuit seeks to have a federal law banning sports betting in New Jersey and 45 other states declared unconstitutional.

"Today’s filing sends a clear message that we will not sit back and allow the selective prohibitions of this law to deprive New Jersey from the economic benefits sports betting can generate," Governor Corzine said.  "We must do everything in our power to ensure both the casino and horse racing industries in New Jersey remain competitive, especially during the national economic recession." 

In the motion, the Governor specifically argues that the Professional and Amateur Sports Protection Act (PASPA):

1.      economically disadvantages New Jerseyans, while allowing select States, including Delaware, to collect revenues from regulated sports betting;

2.      precludes the Governor, from proposing, as a revenue option, a form of regulated gambling freely allowed in other states;

3.      precludes the voters and elected representatives of this State from determining which gambling activities should be authorized;

4.      limits the Governor’s, and New Jersey’s, ability to regulate sports betting activities while other states are free to do so; and

5.      subjects the State of New Jersey and its citizens to civil action should they attempt to authorize or undertake sports betting activities allowed in other jurisdictions.

Since 1992, federal law has outlawed wagering on sports except in four states, Nevada, Montana, Oregon and Delaware.  Delaware recently took advantage of its exemption in the federal law to legalize sports betting and table games at its three horse racing facilities.

If the PASPA is declared unconstitutional, New Jersey could move to authorize sports betting.  Both the New Jersey General Assembly and State Senate have passed measures indicating their support for sports betting in New Jersey.  On February 7, 2008, the Assembly passed by a large majority a bill which would authorize certain sports betting in casinos with voter approval.  On February 23, 2009, the State Senate unanimously passed Senate Resolution No. 12, urging the United States to lift the ban on sports betting.

New York Stock Exchange Removes Casino Operator Riviera Holdings

It was finally the end of the road on Friday for casino operator Riviera Holdings Corp. The company’s stock was de-listed from the New York Stock Exchange, meaning that no more common shares will be traded.

The company had already agreed earlier this month to de-list their stock because they could not comply with standards. Their inability to meet the deadline for compliance has caused the NYSE to de-list the stock on Thursday.

The NYSE sent a letter to Riviera Holdings indicating that the company did not appear to have the financial stamina to continue to operate. The letter also cited “substantial” losses by the company.

“This is just another example of how the casino industry is being among the hardest hit by the recession,” said observer Will Needler, “this is not the first, nor will it be the last casino operator that is de-listed.”

While many of the smaller casino companies have had their problems, the big companies are struggling as well. Trump Entertainment was de-listed from the NYSE several months ago, and other companies are struggling to stay financially viable.

MGM Grand, Wynn Resorts, and Las Vegas Sands have all restructured debt and made other financial decisions to free up capital in the first half of the year.

Republican Rep. Young Signs On As Frank Gambling Bill Co-Sponsor

Representative Barney Frank has more reasons to believe that this time around he will succeed in overturning the Unlawful Internet Gambling Enforcement Act. One of the main reasons is a bi-partisan effort. That was exhibited again on Tuesday.

Alaska Republican Representative Don Young has become the thirty-fifth co-sponsor for Frank’s online gambling Bill. The legislation would ensure that the UIGEA was overturned and also lay the framework for legalization and regulation of Internet gambling in the US.

“The amount of support that Frank is receiving from Republicans is a strong sign that this Bill has a great chance of passing,” said observer John Blasky, “once these Bills gather momentum, they are hard for opponents to stop.”

Even staunch opponent of online gambling Rep. Spencer Bacchus admits that it will be difficult to keep Internet gambling illegal in the US. He has acknowledged that Republicans caught Democrats off guard when they attached the UIGEA to a port security Bill.

Bacchus knows that now online gambling proponents on Capitol Hill have done their homework, and will be fully prepared to defend their position this time around. Truth be told, there may not be many opponents left to online gambling.

The US has watched how other countries have successfully implemented Internet gambling laws and regulations. These countries have made millions of dollars in tax money from online gambling operators, and this is not a a time when lawmakers want to turn down those types of revenue streams.

“Barney Frank is gaining momentum and the move by the government to seize winnings set for online poker players in the US has drawn the ire of millions of Americans,” said Blasky, “this no longer is under the table type of issue. People are upset about the current laws, and they are letting their local politicians know how they feel.”

The fact that Young, who is one of the longest serving Representatives in Washington, signed on to the Bill is a huge step in the right direction. It was the “old-school” Republicans that helped block Frank’s attempt last year to overturn the UIGEA, and the idea that some of them are now in favor of Internet gambling legalization is uplifting for the online gaming community in the US.

More Guilty Pleas in BetonSports Case

The brother and sister of BetonSports founder, Gary Kaplan, have plead guilty Monday and agreed to forfeit millions in gambling profits, though it is unclear where they will come up with those millions since neither were paid very well as mere "supervising employees" of the company. 

Neil Scott Kaplan, 43, plead guilty along with his older sister, Lori Beth Kaplan-Multz, 48.  The younger Kaplan had left the company years before indictments were handed down.  His first two years in Costa Rica were spent sharing a three bedroom apartment with other marketing employees in San Pedro, a suburb of San Jose. 

Another interesting development is one of Penelope Ann Tucker, 64, pleading guilty.  Tucker was Gary Kaplan’s long time accountant who spent much of her time in Antigua before relocating to Costa Rica in 2002.

Tucker’s arrest in the States was announced long after the initial indictments were handed down.  She was not among those named in the first indictment of July 2006.  Two other defendants remain at large.

Each pleaded guilty to a felony racketeering conspiracy charge and agreed to turn over money held in Swiss bank accounts reportedly linked to their earnings while at BetonSports.  The Kaplan siblings also pleaded guilty to an additional conspiracy charge.

Back in April, former BetonSports CEO, David Carruthers, also plead guilty. 

A federal grand jury handed down the indictment against Gary Kaplan, Carruthers and some of its executives as well as a few low level employees.  Also indicted were three individuals who ran a separate marketing and promotions firm that worked closely with BoS.

2009 US Open Odds (Updated for Sunday)

With Ricky Barnes leading the way at the 2009 US Open heading into what would normally by the final round, 2009 US Open odds have been updated at Sportsinteraction.com.

Interestingly enough it is not Ricky Barnes who was listed as the favorite heading into Sunday but rather Mike Weir, who was three down, but also the most prominent of the top three.  Weir would pay out $325 for every $100 bet with a win.

Ricky Barnes, meanwhile, would pay out the same amount as Tiger Woods – $1000 for every $100 bet. 

"That’s a steal considering what Barnes had accomplished on Saturday," states Don Shapiro of Gambling911.com.  Barnes set an all time record by ending the second round with a 36-hole total of 8-under-par 132. 

Barnes took over the lead from Lucas Glover, who was now in 2nd place and promised a payout of $400 for every $100 bet.

But one of the two highly touted favorites to win the 2009 US Open heading into the tournament is still in the thick of things:  That being Phil Mickelson.   He’s only down tied in 12th position compared to Tiger Woods in 34th.  Mickelson would pay out $900 for every $100 bet.

More Than $30 Million Frozen in Online Poker Accounts

As first reported on Gambling911.com Friday, the US Attorney’s Office out of New York has put a stop to the Instant eCheck deposit and withdrawal method at both Full Tilt Poker and Poker Stars.  More information has come out Tuesday as it was now revealed that the US Government has seized some $30 million of both online poker company funds.

The Poker Players Alliance told The Associated Press that the U.S. attorney for the Southern District of New York instructed three banks to freeze the accounts.  The PPA has long insisted that the Unlawful Internet Gaming Enforcement Act (UIGEA) does not apply to online poker. 

Documents obtained by the AP show that a judge in the district issued a seizure warrant last week for an account at a Wells Fargo bank in San Francisco, and that a federal prosecutor told a bank in Arizona to freeze an account.

The Associated Press reports that  a letter dated Friday and faxed to Alliance Bank of Arizona, the prosecutor said that accounts held by payment processor Allied Systems Inc. are subject to seizure and forfeiture "because they constitute property involved in money laundering transactions and illegal gambling offenses." The letter was signed by Arlo Devlin-Brown, the assistant U.S. attorney for the Southern District of New York.

Devlin-Brown also asked that the banks treat the monies as "legally seized funds" by the FBI, stating that the US Government has "probable cause that the gambling payments of U.S. residents had been directed to offshore illegal Internet gambling businesses". 

So far only Poker Stars and Full Tilt Poker appear to be affected by this latest seizure.

John Pappas, executive director of the Poker Players Alliance, called the government’s move an "unprecedented action" against online poker players.

In a letter Monday night to Devlin-Brown, Pappas said that the funds belong to the alliance’s members, and requested that his group be notified and given the opportunity to be heard regarding attempts to seize the frozen funds.

"The PPA will pursue every legal course available to ensure that poker players’ funds are not seized and their right to play poker online is protected," he wrote. The US Justice Department apparently sees things different than John Pappas.

Late last year, PartyGaming founder, Anurag Dikshit, pled guilty to illegal Internet gambling and agreed to cooperate with the U.S. Justice Department in an investigation of Party Gaming, which prior to passage of the UIGEA, owned the largest online poker room in the world, PartyPoker.

Dikshit entered the plea to one count of online gambling in violation of the Federal Wire Act, which the PPA has long insisted does not apply to online poker.  Dikshit also agreed to forfeit $300 million.

"I came to believe it was in fact illegal under U.S. law," Dikshit told U.S. District Judge Jed Rakoff in New York, referring to PartyGaming’s activity. "I have taken full responsibility for my actions."

Ironically, it was PartyGaming that initially helped in the creation of the Poker Players Alliance.  At the time of Dikshit’s plea, many industry analysts believed Party’s co-founder had opened a can of worms. 

Customers of PokerStars have confirmed payment of winnings by other withdrawal means, however, the eCheck features remain dismantled.

Bet The 2009 French Open: Odds Still Available

If you thought it was too late to bet the 2009 French Open, guess again.

World number two Roger Federer was back to his brilliant best as he eased past local favourite Gael Monfils 7-6 6-2 6-4 to book his place in the French Open semi-finals on Wednesday.

The Swiss will play his 20th consecutive grand slam semi-final against Argentine fifth seed Juan Martin del Potro (+600 or 6/1 odds), who he has beaten in their five previous encounters.

Among the women, Dinara Safina was about as big a favorite to win as Roger Federer is for the men.

The 23-year old Russian will play the No. 20 seed Dominika Cibulkova of the Czech Republic, who is making her Grand Slam semifinal debut.

Full Tilt Poker PR Rep Won’t Deny Russ Hamilton Overtures

Though it’s probably safe to assume Full Tilt Poker will think twice about hiring alleged online poker cheat, Russ Hamilton, following a story that appeared on the Pokerati website this week, a spokesperson for Full Tilt refused to deny whether Hamilton was being considered as a Team Full Tilt player.

"Who said Pokerati is a reputable source?" asked spokesperson Michele Clayborne.  "There are inaccuracies in that article".

The University of Southern California graduate would not clarify the precise inaccuracies when asked repeatedly to do so.  She was repeatedly asked to explain where Pokerati was getting its information, to which Ms. Clayborne reiterated they do not consider Pokerati a reputable source.

"We will not be talking to Gambilng911.com ever again!" she snarled in yet another phone call made by Gambling911.com Senior International Correspondent, Jenny Woo.  "Why don’t you take that article down off the site?"  

Clayborne represents Full Tilt Poker and its team of pros through EMC-PR, where she holds the title of  International Public Relations Consultant (IPRC).  Apparently one of her job requirements is to piss off the press.

Even Gambling911.com questioned the Pokerati story (a la the question mark in the headline).  However, we suspect after speaking with Clayborne, who supposedly was a Creative Writing major, she wouldn’t know a question mark from a period (that’s not to say this woman doesn’t know what a period is since she appeared to be having hers when we spoke to her Thursday).   We even started our coverage of the story by asking:  "Could this be some type of joke?"  Following our brief conversation with the abrupt woman, we were left cringing at the notion that it might not be.   Perhaps a "real" Full Tilt spokesperson can clarify for us.?.?.?

Clayborne and Full Tilt Poker’s lack of disclosure related to this story has had the entire online poker community riled up in recent days.

Addressing the online poker community concern over news that Hamilton might be hired, Full Tilt Poker issued a statement:

"We are aware of the situation regarding Absolute Poker and UltimateBet as it has impacted the entire poker industry. We certainly understand and share your concerns.

We can confirm that we are regulated by the Kahnawake Gaming Commission, however we cannot comment on our hiring policies/practices. Rest assured though that all necessary precautions are taken with every new potential employee.

Full Tilt Poker is endorsed and trusted by some of the best poker players in the world, and we work hard around the clock to ensure the highest integrity and security of our games.

We also cannot make any comment regarding the hiring practices of other companies within the industry nor can we comment on what communication we have with one another"

"Needless to say, Full Tilt Poker’s response was met by an overwhelming amount of negativity," our friends at AintLuck.com pointed out on Thursday.  "In a world in which the online poker world is fighting to be accepted by the United States, one would hypothesize that being more open when dealing with players’ concerns would rank high on their list of priorities."

AintLuck.com noted that Full Tilt Poker rival – and twice its size – PokerStars.com – was more clear in assuring they would not hire the likes of Russ Hamilton.

A PokerStars spokesperson stated:  "PokerStars has an extensive and stringent employee recruitment process. Relevant staff members face extensive background checks to ensure that they are suitable for the roles which they are hired. If PokerStars is given information about anyone involved in this scam, then we will ban them from playing on Stars."

"In this scenario, it seems that the players responding in the forum are reinforced in their belief that Poker Stars is more inclined to ease the concerns of their customer base,"  AintLuck.com suggests.  "By failing to take the needed time to address the players’ query regarding such a serious matter, they are unwittingly creating more doubt in the minds of prospective customers who just want to be confident that they are being treated fairly.  It would seem that Full Tilt’s relationship with the aforementioned Kahnawake Gaming Commission is the root of the cryptic nature of their response.  Until they can provide some solid proof of their hiring practices, in the backs of the minds of many players, there will be some doubt."

Ms. Woo, who had arranged to interview poker pro Jennifer Harman in an effort to promote awareness of Ms. Harman’s charitable work with Creating Organ Donation Awareness (CODA), has now been denied access to the Team Full Tilt player by Clayborne.  Woo herself is an organ donor.  She has also been especially active in promoting the charitable efforts of fellow poker player Annie Duke, most recently Refugees International.

"You will NOT be talking to MY poker players!" Clayborne exclaimed as if she owned the company.   

Woo, a Mathematics major, was left scratching her head. 

"Isn’t Michele’s (Clayborne) job to get these people and Full Tilt Poker positive press?" Woo asked.   "I seriously cannot believe how unprofessional and disrespectful this woman was.  We made it clear Full Tilt Poker was given every possible opportunity to say three simple words:  ‘Russ Is Not Joining Our Team’."

We reiterate, Full Tilt Poker is more than welcome to clarify the Pokerati story and dispel any rumors related to alleged affiliations with Russ Hamilton.

Rafael Nadal Gone From French Open: Payout Odds Huge

Heavily favored Rafael Nadal has been knocked out of the 2009 French Open as has another contender with short odds, women’s tennis player Ana Ivanovic.

Nadal was defeated by huge long shot, Robin Soderling of Sweden. 

Nadal has dominated the French Open since his first match on the red clay at Roland Garros. In his 31 previous matches, he had lost only seven sets — the last one coming against Roger Federer in the 2007 final.

Nadal had won three of the last four major titles, missing out only on the U.S. Open. Because he won the Australian Open, he had been the only man with a chance to complete a Grand Slam.

He had also been trying to become the first man to win five straight French Open titles.

Soderling was seeded 23rd at this year’s French Open. 

Soderling would pay out approximately US$500 for every US1 bet at Sportingbet.
